      <image:caption>Discrimination means to suffer different treatment because of who you are.  Currently the Equality Act 2010 defines most though not all acts of discrimination in the workplace. It is illegal to discriminate against a person on the ground of their gender, pregnancy/maternity, marriage/civil partnership, gender reassignment, sexual orientation, religion or belief, race, disability, age, as a part-time worker and the membership or non-membership of a trade union. These are ‘protected’ by law. Discrimination can be experienced directly and indirectly. Direct discrimination is a worker being treated less favourably as a result of an action against them. Harassment, exclusion and victimisation are all examples of this. Indirect discrimination happens when an employer fails to act, or tolerates actions which create hostility, or impact disproportionately on a group of workers who are identified as ‘protected’ by equality legislation.       <image:caption>Bullying and harassment can happen in any workplace and can take many forms. It essentially takes the form of an abuse of power by one worker over another worker. It can involve manipulation, coercion, mis-representation, violation of privacy and freedom within or outside of the workplace. The abuse can come from both managers and the people they manage and frequently takes place ‘invisibly’ - without leaving an evidence trail or in front of witnesses. If unchecked it can adversely affect workers physical and particularly mental health and demoralise and diminish the performance of the workforce. Verbal abuse or use of derogatory language, violence, discrimination, exclusion and isolation, defamation of character, harassment, plagiarism, and false allegations are some of the more prevalent forms of bullying. All direct, and indirect, discrimination is by definition a form of bullying. Where bullying is institutionalised, when a culture exists which is tolerated at many or even all staffing levels, it constitutes a ‘whistleblowing’ issue. Employers should have clear policies relating to the management of bullying and harassment in the workplace and they should take a zero tolerance approach to addressing it.       <image:caption>All employees are entitled to a statutory minimum of 5.6 weeks paid holidays per year - including temporary workers, fixed term workers and those on zero hours contracts. Employers may award contractually more than the statutory holiday entitlement.  Employers may decide that workers can only take holidays they have ‘accrued’ (earned on a monthly basis) particularly new employees. Employers have the right to refuse holiday requests but must allow employees time to take their entitlement.  Employers may ask workers to take holidays at specific times. For example where work seasonally fluctuates or the workplace historically closes such as Christmas and Easter breaks. Employees should be paid ‘their usual pay’ when taking holidays - this should include regular bonus payments and overtime. Where a workers pay fluctuates an average should be calculated based the previous 52 weeks earnings.
